1Who this covers
This policy applies to consumer health data that Second Season Health LLC ("Second Season," "we," "us") collects through secondseasonhealth.com. It is written for people protected by the Washington My Health My Data Act (RCW 19.373), Nevada's consumer health data law (NRS 603A.400 to 603A.550) and Connecticut's data privacy law (Conn. Gen. Stat. 42-515 to 42-526). It applies to you if one of these laws protects you.
2What consumer health data means
Consumer health data is personal information about your health. Under Washington's law it includes information about buying or using prescribed medication and reproductive or sexual health information, and it can include information derived from other data, such as which pages you visit on a health website. Connecticut treats personal data used to identify a physical or mental health condition or diagnosis, including reproductive or sexual health data, as sensitive data.
3How this relates to HIPAA
When a licensed provider reviews your assessment and treats you, the medical record they create is protected health information under HIPAA. It is handled under the provider's Notice of Privacy Practices, as our Privacy Policy explains. This policy covers the rest, mainly what happens on secondseasonhealth.com.
4What we collect and why
- That you visited this site and whether you chose to get started, with the details your browser sends on any visit, such as your IP address and browser type. A visit to a health website can suggest an interest in a treatment, so we treat this as consumer health data. We collect it for advertising only if you say yes when we ask.
- Messages you send us by email or phone, so we can answer you. We collect these because you asked us to respond.
- Your privacy choice, with the date and the wording you saw. It is kept in your browser so the site remembers it.
We collect this from you and from your device. Your assessment answers are entered on our care platform at my.secondseasonhealth.com and go to your provider, as section 3 explains.
5Your consent
- On this site we ask before we collect or share consumer health data, except what we need to answer a request you make.
- We ask 1 question, for 1 purpose: whether we may tell Meta that you visited this site and whether you chose to get started. If you say no, or do not answer, nothing is sent from this site.
- We never take consent from our terms of use, from you hovering over or closing a message, or from a design meant to steer you.
- You can withdraw your consent at any time, as easily as you gave it, with Privacy choices at the foot of every page.
6Who we share it with
On this site we share consumer health data only with your consent, with service providers that process it for us under contract and must keep it confidential, or when the law requires it.
- Meta Platforms, Inc. (Facebook and Instagram), an advertising platform, only if you say yes. We use the Meta pixel on our home and contact pages. It tells Meta that you visited and whether you chose to get started, along with details your browser sends, such as your IP address, your browser type and cookies that let Meta recognize your browser. Meta uses this to show us which of our ads work and to decide who sees our ads, under its own terms and privacy policy.
- Service providers that run this site and our email, such as our web host, which process data only for us.
The assessment and checkout pages at my.secondseasonhealth.com are run by our care platform. Those pages tell Meta that a step happened there, such as starting an assessment or placing an order, to measure our ads and decide who sees them. We do not upload customer or patient lists to advertising platforms.
7We do not sell consumer health data
We do not sell consumer health data. Washington and Nevada would require your signed authorization before any sale, and Connecticut your consent. We do not ask for either, because we do not sell it.
8No geofencing
We do not draw a virtual boundary around a clinic, a pharmacy or any other place where health care is provided in order to identify people there, collect their data or send them ads.
9Who can see it
Only people and service providers who need consumer health data to do their work can see it, and they must keep it confidential.
10Your rights and choices
- See it. Ask what consumer health data we hold about you, for a copy, and for the list of who we have shared it with.
- Correct it. Ask us to fix anything that is wrong.
- Delete it. Ask us to delete it, apart from records the law requires us to keep.
- Withdraw consent. Stop us collecting or sharing it at any time, with Privacy choices at the foot of every page or by email.
If we turn down a request, you can appeal. We will not treat you differently for using these rights. To make a request, email [email protected].
11How we protect it
We use administrative, technical, and physical safeguards designed to protect your information, including encryption in transit and access controls. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If we become aware of a breach affecting your information, we will notify you as required by law.
12Changes to this policy
When we change this policy, we will post it here with a new effective date. We will ask for your consent again before we use consumer health data for a new purpose.
